It happens all the time. A staff member agrees to work overtime and then gets sick. That leaves the tricky question of “Are they entitled to receive sick pay?”
The short answer is yes. The employee is entitled to receive sick pay if they have agreed to work additional hours as overtime but are too ill to work them. However, the employee also has the option to take unpaid sick leave for the overtime hours they would have worked.
It’s their choice but whatever they choose to do, you need to keep a written record and when they return to work, it’s a good idea to ask them to sign it as well.
