One of our clients was recently taken to the Fair Work Commission by an employee.
This employee was paid above award rates and we ensured their employment agreement contained very clear expected working hours.
During a busy period, our client asked the employee to work a few extra hours. The employee worked these hours but when they didn’t receive overtime pay, they challenged the arrangement with the Fair Work Commission.
The Outcome
With our help, the client has detailed employee files and payroll systems. As a result, it was easy for our client to provide the Commission with:
- A copy of the employment agreement demonstrating the expected work hours
were clearly stated Time sheets showing these expected work hours were usually adhered to- Pay records of all staff members to demonstrate our client pays their staff well above award rates
- 4 months of
pay slips requested by the Commission as evidence of the above award payments.
The Fair Work Commission agreed our client was in the right and the claim by the employee was dismissed.
Lessons Learned
When you have the proper documentation in place and the paper trail to support it, you have nothing to fear if an employee takes you to the Fair Work Commission.
